Terms and conditions

This article describes the terms and conditions that apply to all requests, calculations and agreements with holapedro. We ask the client to agree to these terms and conditions at the time of a transaction so that they are aware of mutual expectations and obligations.

1. The service

Holapedro is an information platform that helps meet the requirements for applying for finance in Spain. If necessary, holepedro puts you in touch with a mortgage intermediary or a Spanish bank that makes an offer to take out a mortgage. No financial advice is given to the client, but information is provided on how to take out and operate a mortgage in Spain. All contacts run directly after presentation between customer and third party. Questions about the content of the offer are therefore for the client to discuss and negotiate among themselves with the bank/broker. holapedro will not participate in these negotiations.

We are not responsible for other matters such as legal verification of documents, requesting the NIE number or negotiating the purchase price. We share (Dutch-speaking) contacts from our network so that the client is provided with these services.

2. Becoming a customer

The client signs our terms and conditions via data submission through our systems. Confirmation to share data comes via a payment through our system; which is seen as an order for services to put you in touch with a mortgage advisor from a recognised body to broker a mortgage application in Spain. Part of this is that we review your financial details and/or documents beforehand so that a thorough assessment can be made.

3. Terms of payment

Through payment of the assignment (including but not limited to the mortgage indication) fee via payment system Stripe, agreement is given to holapedro's general terms and conditions and privacy policy. This payment takes place prior to delivery service and is considered a digital signature.

4. Delivery of documents

Customer shall timely provide all information and where possible documents for mortgage advice. Customer acknowledges that services may be delayed if the information provided by Customer is not complete or sound. Customer is responsible for providing the correct information and documents.

5. Period of validity of products and services

holapedro is responsible for putting the customer in touch with a third-party contact. This will arrange its own validity of services. However, there is validity on the financial data and where necessary documentation used by the Spanish bank to make a mortgage offer.

A mortgage offer is valid for one month. After the expiry of this month, more recent documents should be provided to reassess the file and the calculation. The client is aware that the interest rates and other conditions of the offer are subject to changes in the mortgage market in Spain during the resubmission period.

Holapedro's mortgage indication report is thus relevant even 1 month after its issue. The validity of the advisory report can therefore be rejected by a mortgage adviser if there is a longer period between the request for an indication report and the interview. The mortgage consultant may be able to request new or additional information.

6. Acceptance and validity of products and services

The services provided or the products sent are not a condition for acceptance by third parties (being mortgage adviser or lender). The services provided by holapedro are informative and indicative. Although the information gives a true and realistic picture, it is not an official document, which has been approved by a recognised specialist.

The third parties always retain the right to reject any delivered product or indication of holapedro.

7. Mortgage indication & indicative calculations

The calculations issued by holapedro are based on the information provided by the customer in the application form. These offers are always indicative and subject to documents and valuation. An acceptance by a mortgage advisor or a lender cannot be guaranteed with this indication. holapedro is therefore not liable for any damage, of whatever nature, resulting from the client's misinterpretation of the calculation or quotation.

8. Refund conditions

holapedro has the following refund policy:

  • Customer is not satisfied with content of purchased product, after expired clause 8.1 (0% refund)
  • Purchased service is not provided by holapedro; or third-party involved parties (75% refund less processing fee)
  • The customer stops the service itself (0% refund).
  • Rejection of funding application due to default of customer and/or third party engaged (0% refund). This includes:
    • Customer is not satisfied with third-party service. This does not relate to services provided by holapedro.
    • Mortgage advice office approves data supplied by holapedro.
    • Service fails (buyer or seller withdraws).
    • Customer provided false information to holapedro which resulted in lender not providing mortgage.
    • The appraisal: If, for instance, the appraisal value is lower than the purchase price, this will also affect (negatively) the mortgage offer. Due to a possible lower mortgage amount, the client will be hindered from buying the property.
    • Defects of the collateral (permits/house built illegally).
  • If there is fault due to unintentional actions or shortcomings from holapedro, then a goodwill arrangement may take effect. This involves 25% refund of the deposit to holapedro. The customer is never entitled to this coulance arrangement and is granted on the basis of investigation by holapedro.

8.1. Refund Digital products

All our automated digital products are subject to a 14-day no-quibble money-back guarantee. This applies to products where no additional information has been provided via a holapedro employee. If we receive the refund request within 14 days, we will refund the entire amount minus handling fees to the account used to request the product.

9. Suspension of service

The customer can choose to withdraw from holapedro's services or the mortgage application process through the third party at any time. Our fees will not be refunded if the customer does not wish to pursue the mortgage application. Delay, in any way, is not a valid reason for cancellation of the mortgage application.

holapedro also reserves the right to unilaterally suspend services if the client is found to be in default, e.g. in providing documents (on time or correctly). See also the article on refund conditions.

10. Other general terms and conditions

The liability of holapedro is in all cases limited to the amount equal to the intermediate costs paid through the online payment system. Holapedro is also not liable for indirect damages such as consequential damage or loss of profit. These general terms and conditions are governed by Dutch law. All disputes arising herefrom shall be submitted to the competent court in the district of Breda.

The agreed rate is the price listed on the website and paid via the online payment system. It is possible to receive a PDF statement in the currency euro on request.

The texts, prices and services offered on the holapedro.com website are always informative and therefore indicative. No obligatory rights can be granted to the (in)correctness, and/or claims can be made to the performance of the mentioned services against remuneration in the exact form as described.
